Fed:Problem gambler fails in bid for further appeal to sue club
A problem gambler has come to the end of the road in his world-first bid to make aclub responsible for his wagers.
Former milkman CHRIS REYNOLDS sued the Katoomba RSL Club in New South Wales for nearly$57,000 in compensation, claiming it failed to prevent him gambling away thousands ofdollars.
Today Australia's highest court refused him leave to appeal because of a lack of evidenceavailable from previous hearings.
Mr REYNOLDS first claimed in a New South Wales District Court he'd told the Blue Mountainsclub he was a problem gambler.
He claimed the club breached its duty of care by cashing cheques from him and givinghim credit between 1992 and 1994.
When that court ruled in December 1999 that Mr REYNOLDS was a free citizen and responsiblefor his own actions, he went to the Court of Appeal.
The NSW Court of Appeal dismissed his case last September and ordered him to pay costs.
High Court Chief Justice MURRAY GLEESON and Justice KENNETH HAYNE today ruled out afurther appeal.
